1. Acceptance of Terms
By accessing or purchasing from Peptique (“we”, “us”, “our”), you agree to be bound by these Terms of Service. If you do not agree, you must not use this website.
2. Legal Framework
These Terms operate in accordance with the Competition and Consumer Act 2010, including Schedule 2 known as the Australian Consumer Law, which applies to all consumer transactions in Australia.
Nothing in these Terms excludes, restricts, or modifies any rights you may have under Australian law.
3. Eligibility
By purchasing from Peptique, you confirm that:
- You are at least 18 years of age
- You have legal capacity to enter into a binding agreement
- You are purchasing for lawful purposes
4. Research Use Only
All products sold by Peptique are strictly intended for laboratory research purposes only.
Products are not for human consumption, therapeutic use, veterinary use, clinical use, or diagnostic purposes.
By purchasing, you agree:
- You are qualified or purchasing on behalf of a research entity
- Products will be handled by trained professionals
- You accept full responsibility for use, storage, and handling
Peptique disclaims liability for any misuse.
5. Product Nature & Appearance
All products are supplied as lyophilised (freeze-dried) compounds unless otherwise stated.
You acknowledge and accept that:
- Variations in colour, texture, crystallisation, or distribution are normal
- Certain compounds (including copper peptides such as GHK-Cu) may display blue or darker colouring due to their chemical structure
- Freeze-dried materials may appear uneven, clumped, or compacted
These characteristics do not constitute contamination, defect, or failure.
All products are:
- Sealed
- Sterile at dispatch
- Stored under controlled (refrigerated) conditions prior to shipment
6. Orders & Payment
- All prices are in AUD
- Payment must be made in full prior to dispatch
- We reserve the right to refuse or cancel orders at our discretion
Orders are only confirmed once payment is successfully received.
7. Shipping & Delivery
- Shipping timeframes are estimates only
- Once dispatched, delivery is handled by Australia Post or a selected courier
- Delays caused by external factors or global circumstances are outside our control
Risk transfers to the customer upon dispatch.
8. Refunds, Returns & Consumer Guarantees
8.1 Change of Mind
We do not offer refunds or exchanges for:
- Change of mind
- Preference-based dissatisfaction
- Misunderstanding of product appearance
Under Australian law, businesses are not required to provide refunds for change of mind .
8.2 Product Condition & Inspection
Products are not considered faulty where:
- They match their description
- They remain sealed and uncompromised
- They display normal variations of lyophilised material
8.3 Returns for Inspection
If you believe a product is faulty:
- You may request a return for inspection
- Return shipping is at your expense
- Items must be unused and sealed
We reserve the right to assess the product before determining any outcome, as permitted under Australian Consumer Law .
8.4 Consumer Guarantees (ACL)
Under the Australian Consumer Law, products must:
- Be of acceptable quality
- Match their description
- Be fit for purpose
If a product fails to meet these guarantees, you may be entitled to a remedy such as repair, replacement, or refund .
8.5 Major vs Minor Faults
- Major failure: Customer may choose refund or replacement
- Minor failure: Business may choose repair or replacement
A product is only considered faulty if it is unsafe, significantly different from description, or unusable .
9. Limitation of Liability
To the maximum extent permitted by law:
- Peptique is not liable for indirect or consequential losses
- Liability is limited to the purchase price of the product
We are not responsible for:
- Misuse
- Improper storage after delivery
- Use outside intended research purposes
10. Misleading Conduct
Peptique complies with laws prohibiting misleading or deceptive conduct under the Competition and Consumer Act 2010, including representations about product quality and characteristics.
Customers acknowledge they have reviewed product descriptions prior to purchase.
11. Chargebacks & Disputes
By purchasing, you agree to contact us first to resolve any issues.
We reserve the right to:
- Dispute chargebacks with supporting evidence
- Provide product specifications, policies, and correspondence to financial institutions
12. Indemnity
You agree to indemnify and hold Peptique harmless from any claims, damages, or legal costs arising from:
- Misuse of products
- Breach of these Terms
- Violation of applicable laws
13. Privacy & Data Protection
Your data is handled in accordance with Australian privacy laws and our Privacy Policy.
We take reasonable steps to protect your personal information.
14. Governing Law
These Terms are governed by the laws of Australia. Any disputes will be handled within Australian jurisdictions.
